Your File Owner will then adjust it. STEP 3. Your File Owner will liaise with all 3rd parties like the bank, other sides solicitor and other authorities to lay the groundwork for settlement.

When this is all done, we’ll attend settlement on your behalf to make sure there are no last minute hiccups. A settlement is where the change of ownership of the property is ‘official’. Our Head Office is located only 2-minutes walk away from the main Victorian settlement centres – so if anything happens – the lawyer will walk over to sort out any issues on the spot. Once Settlement is affected, you and your agent will be notified asap and our team will conclude the process with a Post Settlement Letter to you, containing all reference details you will require from the transaction. Have a Section 32 (Vendor’s Disclosure Document) or a Contract of Sale? Getting a review before signing is the industry BEST practice. This is when you have the most power to NEGOTIATE your needs and rebalance the often single sided contracts that are prepared – whether that be inclusions, chattels, settlement dates or anything else untoward. A one-on-one contract review of your contract (NOT a generic advice like some firms provide) ensures a better understanding of the conditions and terms you are agreeing to, as well as what is reasonable to negotiate. Where possible, it is best to purchase on your terms, not the sellers. Unless you read contracts every day, you will not be aware of what is fair, what is reasonable to request, amend or remove. More specifically, you will not know what has been deliberately or mistakenly omitted. Often times, these are the most important things to be aware of. The hidden but immense value of the review is taking advantage of the lawyer’s experience. It’s not just what is IN the contract, but is also what is missing that could (should) be added.
