PART A

What Is Our Approach?
Acting as your legal representative, your team will work with your bank, the vendor’s solicitor, and other related parties, to set the groundwork for a successful and smooth settlement of your land.
All the below steps are included as standard practice, so you can be confident that your land purchase is being handled with professionalism, efficiency and care.

  Contract Exchange Corresponding with the Vendor’s Representatives for Negotiations and Exchange of the Contract.
  Order Searches Ordering necessary searches to check for legal liabilities.
We’ll make sure all the Seller’s bills are paid…
  Adjustments Make sure that you don’t inherit any outstanding rates, bills, etc.
  Facilitating Stamp duty payment Prepare documents and assist with stamp duty payment (if required).

PART B

What Are The Costs?
The conveyancing process, Lawyer and team are included within the professional fee (inc GST). Our professional fee is 100% fixed. The only other cost you need to consider are the necessary searches.
As part of a safe conveyance, we must order third party searches to verify the contents of the Contract Of Sale and to uncover any outstanding rates, water bills, land tax, etc owed on the property. This information is critical for due diligence and gives your Conveyancer the dollar amount needed to be recovered from the Seller (obviously, you don’t want to pay for past bills).
We will order the searches on your behalf, pay costs up-front, and then pass this cost to you upon settlement.
Please note that conveyancing fees are dependent on property type, City Council (at time of order) and lot specifics. So request a quote now to receive up-to-date prices.
As per our guidelines, we RENDER SERVICE FIRST. Our first invoice (retainer) will be sent with the first suite documents. The balance of actual conveyancing fees and searches is payable at settlement.

What Are 3rd Party Searches?

Searches are used by the conveyancer to do health checks on your property — they are essential and should not be skipped, as the consequences could be financially disastrous.
We use Searches to check for…
  • Outstanding bills; Such as unpaid council rates, water bills, utilities, etc.
  • Outstanding land tax; Land tax due to the Office of State Revenue.
  • Errors in paperwork; Cross checking the name, lot and transfer details.

What Searches and Services Are Included In The Land Buying Package?

Our package includes the minimum searches needed for a safe conveyance. Again, searches are Council specific, so please request a quote to get specific pricing for your property. Searches below are needed for Land purchases.

Name of Search Description How Does This Item Protect You?
 Title Search Provide title particulars, ownership details and encumbrances on title. Confirm that the Vendor has rights to sell the property and determine any legal encumbrances that may affect enjoyment of the buyer.
 OSR Clearance Certificate Provide details on any outstanding payment of land tax due to the Revenue NSW. Find out how much Land Tax is owed by the Vendor – and if there is an amount outstanding, ask Vendor to pay it off.
 S603 Certificate Provide details of the rates payable for the current billing cycle. Find out if the Vendor has any rates owing – and if an amount is outstanding, ask Vendor to pay it off.
 Water Certificate Special meter read & fixed charges payable for the current billing cycle. Find out if the Vendor has any water bills owing – and if an amount is outstanding, ask Vendor to pay it off.
 Stamping Fee Stamping requirement before or at settlement. Fee required to process Stamping.
 Settlement Attendance Representative to meet with the other party, to complete the transaction. Meet with the bank, or the Vendor’s representative and hand over the cheque with final payment.  Be on site to clear any potential issues (we will send the Lawyer if needed, we are located a two minute walk away).
 File Opening Fee Data protection and electronic encoding. Security and protection of your private details.
 Postage Deliver original documents (excludes courier). Banks often require a physical copy of the paperwork as part of their standard process.
 Check Search Confirms vendor is still the owner prior to settlement. Double check that the seller is still entitled to sell the property, before clearing the cheque and releasing funds.

Are Additional Searches Recommended?

Each property and each situation is different. Generally, most standard residential purchases require no additional searches. However, in certain circumstances, extra searches may be recommended.

For instance, if you’re buying land in where was once a mining area, a S15B Certificate is advisable (and comes at an extra fee). We will not compromise the quality of your conveyance and will only order additional searches on your authorisation.
