Want to SAFELY sell property in New South Wales? It’s a statutory requirement for sellers to include specific documents within the Contract of Sale.
The documents discloses property information like title particulars, encumbrances and plan details in the form of “search certificates”. This is how the government ‘protects’ buyers.

It Prevents Buyers From Withdrawing

If required documents – e.g title documents, drainage diagram and current Zoning Certificate S10.7 (formerly S149) Certificate – are NOT included, or are incorrect/out dated, then the purchaser will be entitled to take legal action or withdraw from the sale between signing and settlement; without any compensation to you.

How Long Will It Take To Draft The Contract Of Sale?

We start drafting the Contract Of Sale on the same day your matter is created. What makes the process time consuming is that we must order and wait for 3rd parties to provide search certificates. As per New South Wales law, these search certificates are required to be included in the Contract Of Sale.
As a conservative estimate, it can take between 5 to 10 business days to get required search certificates from 3rd parties. Despite all efforts, it is largely impossible to dramatically speed up this process.
Once we place an order for the certificate, we have no control over when it will arrive. All conveyancers are subject to third party’s wait time for the return of search certificates. For example, the S10.7 (formerly S149) Certificate is usually slower than the others.
That said, if you do require FAST contract drafting, let us know! Some councils do provide Urgent S10.7 (formerly S149) Certificates at the cost of an “urgency fee” payable to the Council. However, our promise to you is a BULLET PROOF Contract of Sale that is prepared in accordance with New South Wales statutory requirement. We will not compromise on quality and will not omit any details that will put you in jeopardy.
