You Want To Buy Property
STOP! DO NOT SIGN ANYTHING
As a conveyancing-only law firm, we always ask these questions…
Q: Are You Sure This Property Is Right For You?
  • For most States, the mantra is BUYER BEWARE, so do your due diligence;
  • Always review available Vendor Disclosures to understand your binding legal obligations should you decide to purchase;
  • You MUST make sure you know what you’re buying before signing.
Q: Did You Know, You’ll Inherit The Properties Restrictions?
  • By law, you are restricted on what you “can” or “cannot do” with the property;
  • For example, a “Heritage Listed” property may mean no renovations allowed;
  • So, if you have plans to seriously improve the property, check in advance!
Q: Are You Sure The Contract Is Fair For You?
  • Contracts are often-one sided in strong favour of the Vendor;
  • That means less protection for you, particularly if something goes wrong;
  • And that legal jargon often means something totally different (for you).
What You Have Now: Confusion, worry, and the need for somebody to help. It’s an expensive time, so you want to find the best value conveyancing law firm.
Next step: Play it safe and give us a call.
You Need A Contract Review
LEGAL ADVICE IN “EASY TO UNDERSTAND” ENGLISH
Speak To A Conveyancing Lawyer For Advice…
Having a Lawyer review your Contract of Sale is the most value-added step of the entire transaction. This is where you will benefit from legal advice that will 1) rebalance the contract in your favour and 2) make you aware of adverse risk BEFORE committing to a purchase. So send the Contract Of Sale in and:
The Lawyer will:
  • Review the Contract Of Sale line-by-line;
  • Check your state specific Vendor Disclosure Document;
  • Call you to have a brief chat about your concerns;
  • Highlight risks, issues and red-flags;
  • Suggest favourable amendments that mitigates risk;
  • Email you a report with tailored special conditions;
What you get:
  • Information to make an educated decision if this property is right for you – or not!;
  • Concrete actions to take to make your transaction safer;
  • A Lawyer who is trained “not to let go”, who will review, sign off and have custodianship of your purchase.
So if you have an unsigned Contract of Sale, send it in, we’ll create a Matter File and our team will work on it ASAP! As a matter of fact, the team is available to get started 7-days a week!
Next step: You need to negotiate with your Agent to have the Contract of Sale updated. This is as easy as copy-pasting and emailing the provided text to the Agent.
Negotiate & Safely Sign
SIGN ON YOUR TERMS, NOT THE VENDORS!
You’re in the best position to negotiate BEFORE you sign
Your Lawyer would have told you that you may negotiate:
  • Inclusions; e.g The potted plants, chandelier, the BBQ?
  • Exclusions; e.g Removal or change of a condition?
  • Terms; e.g Payment Conditions, Settlement Dates?
Armed with the suggestions provided in the review, you will know what is fair to negotiate and the amendments / special conditions you should ask to be included.
What you get: Should the Vendor agree, you’ll get a better deal. You’ll also get a safer Contract Of Sale that gives added protection (should anything go wrong).
Next step: Send us the fully signed contract so we can begin the conveyance.
Conveyancing Starts
FRIENDLY, RESPONSIVE, START TO SETTLEMENT CARE
We’ll take care of the details so you don’t have to
Conveyancing is the legal process of changing the ownership of property from one party to another. And the moment the Contract is signed is the moment your team gets into heavy gear!
As part of our sophisticated process, your Lawyer will brief and direct your Conveyancer. As an added measure of protection, the Lawyer will always be required to sign off on the all Conveyancers work.
The role of the Conveyancer is to manage the Banks, Customers, other-side, Council, Water Utilities and circumnavigate the tedious immovable rules these big organisations typically have. And your Conveyancer is here to curate the best possible settlement experience for you.
Your Conveyancer will:
  • Hold your hands throughout the conveyancing process;
  • Organise, anticipate and make sure you meet all statutory requirements;
  • Double confirm and get sign-off from the Lawyer;
  • Should anything go wrong, work hand in hand with the Lawyer;
  • Set the groundwork for you to reach an on-time settlement.
As A Law Firm:
What makes us different? We have the most comprehensive insurance in the category, Australia-wide, and we are the ONLY conveyancing law firm with CYBER FRAUD insurance. Our people and process are bulletproof, but if anything goes wrong – which is why you hired a Law Firm, to protect your transaction and family – we will do the work to get you out of it. We’ve got you.
What you get: Trusted advisors that will take care of you.
Next step: Sit tight as we start ordering your searches.
Debt Is Prevented
MAKE THE SELLER PAY ANY OUTSTANDING BILLS
So you get the property with zero bills owed
DEBT TRAVELS WITH LAND
Which results in SETTLEMENT TRANSFERRED DEBT. Should unpaid bills not be discovered during the conveyancing process by error, outstanding debts will be transferred to you, the Buyer.
Significant debts could include: Unpaid Land Tax, Accrued Council Rates, Water Bills to make the garden pretty for sale, Outstanding Body Corporate.
To protect you against this, and make sure that you get the property with zero owed, your Conveyancer will order “Search Certificates” from 3rd parties like the:
  • Land Tax Clearance – Find out land tax due to the Office of State Revenue;
  • Local Council Rates – Details of the rates payable for the current billing cycle;
  • Water Certificate – Details of fees payable for the current billing cycle.
Your Conveyancer will tally up the amount owed and ask the Vendor to pay the bills before settlement happens. This is where your Conveyancer will add value and security to your transaction. It gives you the certainty of no settlement transferred debt.
What you get: No surprise, out of pocket costs at settlement.
Next step: Wait until settlement day.
Settlement Attendance
THE FINAL STEP TO MAKE IT OFFICIAL
We’ll Meet With The Seller’s Solicitor And The Bank
The final step is Settlement. And that’s the day you assume legal ownership of your property.
What happens is that the Seller’s Representative, The Bank, and your Conveyancer meet at a pre-arranged settlement office to exchange paperwork. There the Title and official documents are checked, confirmed by all parties and settlement is agreed upon.
And when all parties are happy, the paperwork is stamped, and the funds are released. The Real Estate Agent is then authorised to give the “OK” to give you the keys.
What you get: Our Head Office is only 2-minutes walk away from the main settlement office in all States (most of the settlements happen in the CBD where we are based). That means should anything go wrong, your Lawyer can simply WALK to the office and take charge.
Next step: Get the keys to your new property!
Congratulations On Your Purchase!
GET THE KEYS FROM THE AGENT
Call the Agent, take ownership
After briefly basking in the glory of a job well done, it’s right back to work for your Conveyancer. Your Conveyancer will do the final paperwork for the transfer and will send an email with all the details.
Meanwhile, your Agent will give you a call to let you know when to pick up the keys. Now all you need to do is let your family know that you’re a proud new property owner. Congratulations
What you get: An on-time conveyance enjoyed by 10,000+ happy Australians!
